INTELLECTUAL PROPERTY (IP) is property that has its roots in the intellect and the imagination.  Patents, copyrights, trademarks and trade secrets are forms of IP.  Protected under the law, IP can have potentially great value for its creators/owners.   In the US, the Constitution (Article 1, Section 8, Clause 8) gives Congress “Power … To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries.”

*Note:  Mr. Sommers is not a member of the U.S. Patent Bar, which has special requirements (patent prosecution attorneys must have some scientific or technical training, such as an undergraduate degree in engineering or biological or physical science, and must pass, in addition to a state bar, the patent bar examination administered by the PTO.)   While he does not engage in patent “prosecution,” Mr. Sommers can and does offer counsel on the basics of patent law, as well as services reviewing, structuring, drafting and negotiating patent licensing or acquisition agreements.
